Mr. Jagadish Chandra Halder …for the Petitioner. Ms. Amita Ghosh …for the State. 1. By the present writ petition, the petitioner seeks direction upon the respondent authorities to take steps for grant of family pension in his favour. 2. The petitioner contends that his father late Mrinal Kanti Mallick was a Head Teacher of 1 No. Laskarpur Satadal F.P. School, District South 24 Parganas. The father of the petitioner retired from service on superannuation on 30th June, 2006 and died on 13th September, 2024 leaving behind the petitioner as the legal heir. The mother of the petitioner predeceased his father and died on 31st July, 2019. The petitioner is a differently abled (particularly Intellectual Disability) son of the deceased employee. On 17th March, 2024, the petitioner made an application before respondent No.4, the District Inspector of Schools (P.E.), South 24 Parganas for grant of family 2 pension. However, the same is still pending consideration. Hence this writ petition. 3. Learned Advocate for the State as well as learned Advocate for the petitioner submits that on 19th March, 2026 the petitioner made another application before the District Inspector of Schools (P.E.), South 24-Parganas and the petitioner has been requested by the concerned authority to submit all requisite papers. The matter is still pending consideration. They jointly submit that the authority may be directed to take a decision on such representation. 4. Report furnished by the District Inspector of Schools (P.E.), South 24-Parganas dated 23rd March, 2026, also reveals that such representation is under consideration. 5. In view of the above, the respondent No.4, the District Inspector of Schools (P.E.), South 24-Parganas is directed to consider the representation of the petitioner dated 19th March, 2026 pending before it and dispose of the same in accordance with law by passing a reasoned order within a period of 12 weeks from the date of communication of this order. 6. The reasoned order shall be communicated to the petitioner within a week of passing thereof. 7. Learned advocate for the petitioner is directed to communicate this order to respondent No.4, the District Inspector of Schools (P.E.), South 24- Parganas, for necessary compliance. 3 8. With the aforesaid direction, the writ petition being WPA 19132 of 2025 stands disposed of. 9. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 10. Interim order, if any, stands vacated. 11. All connected applications, if any, stand disposed of. 12. There shall be no order as to costs. 13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 14.
