Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following reliefs:- “1. It is, therefore, most respectfully prayed that the present Civil Writ Petition may kindly be allowed and the Respondents may very kindly be directed to promote the petitioner from the date of joining the department of respondent no.4 and when then petitioner was handed over the charge store keeper i.e., 09/01/2013 (Annexure P-4). The post of store keeper is a (class iii) Post and the petitioner have been a performing the duties of store keeper. 2. To pay all the arrears @ 10% from the date he was eligible for promotion. 3. To give him seniority and designate him as clerk from 09th January thereafter, petitioner as 2013 and designate junior Assistant w.e.f from January 2018 on completion of five years as clerk with all consequential benefits pay, seniority, etc.” 2. Learned Counsel appearing for respondent No.3 has 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:21695-DB handed over instructions received from Managing Director, Him Process, dated 23.05.2026, which reads as under:- “With reference to the subject cited above, it is to inform you that a matter regarding Pending Dues and Merger/Absorption of employee of HIMPROCESS Sh. Ranveer with HPMC was discussed under Agenda Item No. 1. After detailed deliberations, the Board of Directors resolved that the HIMPROCESS has no objection in case Sh. Ranveer is merged/absorbed with HPMC. However, it was also specifically decided that HIMPROCESS shall not bear any financial liability on account of such merger/absorption, including gratuity, pensionary benefits, arrears, and HIMPROCESS shall not be responsible for consideration or settlement of any prior or subsequent claims in this regard. You are requested to kindly apprise the above factual position before the Hon'ble High Court in the matter, as deemed appropriate.” 3. In light of this development, this petition is disposed of, but with liberty to the petitioner, as prayed for, that with regard to any surviving grievance of his qua HPMC, he may approach either the appropriate Authority or the Court of law afresh.
