Court on its own motion vs. State of H.P. and others CMP No. 12684 of 2026 [Item S-7] 03.06.2026 Present: Mr. Balwant Singh Thakur, Advocate, for the applicant/petitioner. Mr. Sidharth Jalta, Deputy Advocate General, for the respondents/State. The application is sought for permission for organizing a Sports and Cultural Programme in the compound of GSSS Khamadi, Tehsil Nankhari, District Shimla, H.P., on 8th June, 2026 to 9th June, 2026 after 4.00 P.M. onwards. As per the averments, the event is the “Birshi Mela” and is a Volleyball Tournament and cultural programme on the aforesaid dates after completion of school hours, i.e. 4.00 P.M. We are of the considered opinion that since the School is working on the said dates, it would militate against the main judgment passed in the case on 22nd September, 2017, wherein it has been held that the educational institution's premises cannot be used for other purposes except for the purpose of education. Resultantly, we do not find any ground to entertain the application. In similar circumstances, we also dismissed CMP No. 12412 of 2026 on 29th May, 2026 regarding permission to organize the Bodgar Fair in the playground of Government Senior Secondary School, Bogdar, Tehsil Noharadhar, District Sirmaur, H.P., on the ground that the said dates are working days.
