Sarma, learned Addl. Public Prosecutor, Assam, appearing for the State Page No.# 2/2 respondent. The learned Addl. P.P. has submitted that charge sheet has submitted in this case vide C.S. No. 35/2026 dated 30.05.2026 in connection with Ram Krishna Nagar P.S. Case No. 32/2026 (GR Case No. 435/2026). The learned counsel for the petitioner has submitted that the provisions of Section 36 and 48 of the BNSS have been violated which entitles the petitioner to get bail. However, since the records are available only before the learned trial Court, the same may be considered by the learned trial Court, if an appropriate bail application is preferred by the petitioner before the said Court. Accordingly, this bail application is disposed of with the observation that the bail petitioner may approach before the learned trial Court with an appropriate bail application, the said aspect may be considered by the learned trial Court while disposing of the application.
