( 2026:JHHC:13059 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 3706 of 2026
------ Binod Munda, s/o late Bhutka Mundane, aged about 34 years, r/o Village-Khajur Toli, P.O.-Chanho, P.S.-Mandar, Dist.-Ranchi, Jharkhand … Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Gautam Kr. Singh, Advocate For the State
: Mr. Achinto Sen, Addl. P.P. ------
Order No.02 Dated- 04.05.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. No. 774 of 2024 arising out of Nagri P.S. Case No.106 of 2024 registered for the offences punishable under sections 302 of the Indian Penal Code.
The learned counsel for the petitioner submits that this the second journey of the petitioner with the prayer for regular bail. It is next submitted that the trial is at its fag end and all the prosecution witnesses have been examined and the statement under Section 313 of Cr.P.C. has been recorded as also the evidence of the defence is also proved and the case is fixed for argument. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the prosecution witnesses have supported the case of the prosecution during the trial hence, there is no justifiable reason to reconsider the prayer for bail which has already been rejected by this Court on merit vide order dated 14.07.2025 in B.A. No.5804 of 2025. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner and as case is already fixed for argument on the merits in the trial court as well as the fact that the prayer for bail was
earlier rejected, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail at this stage. Accordingly, the prayer for bail of the abovenamed petitioner is rejected.
