1. The petitioner has filed this petition seeking transfer of Criminal Case No. 5948/2022 [State v. Vinod Arora and others] from the Court of the Chief Judicial Magistrate, Shahdara, Karkardooma Courts, New Delhi, to a Court of competent jurisdiction in the District Court, Dwarka, New Delhi.
2. The petitioner is one of the accused in FIR No. 169/2022 dated 23.02.2022, registered at Police Station Vivek Vihar, District Shahdara, New Delhi, under Sections 323/341/506/34 of the Indian Penal Code, 1860, read with Sections 25/27 of the Arms Act, 1959. It is alleged in the present petition that the petitioner and his counsel were manhandled in the Court premises by the complainant’s lawyers, and that the petitioner has been receiving threats from the complainant and his associates.

4. At this stage, it is submitted by Mr. Bankey Bihari, learned counsel for the petitioner, that the petitioner has filed an application on 20.02.2026 seeking permission to appear before the Trial Court through video conferencing, which remains pending.
5. In view of the above, Mr. Bihari submits that the aforesaid application be considered by the learned Trial Court and that, on any date of hearing, if the petitioner is required to appear physically, the Investigating Officer may ensure that the petitioner and his counsel are able to attend the Court without fear or intimidation.
6. Having regard to the aforesaid submissions, the petition is disposed of, with liberty to the petitioner to pursue his application for leave to appear through video conferencing before the Trial Court.
7. Whenever the petitioner is required to appear physically on any date of hearing, he may inform the Station House Officer of the jurisdictional Police Station. The concerned Station House Officer is
directed to ensure that the petitioner and his counsel are able to appear without any threats or intimidation. In the event of any exigency, the petitioner may seek necessary directions from the Trial Court and may approach this Court afresh in the event of any change in circumstances.
8. The petition, alongwith pending applications, stands disposed of in terms of the aforesaid.
