The present anticipatory bail application has been filed under Section 482 of the BNSS, 2023 on behalf of the accused- applicants in connection with FIR No. 112/2025 registered at Police Station Bandikui, District Dausa for the offence(s) under Sections 189(2), 115(2), 126(2), 329(3), 351(2), and 352 of the BNS, 2023. The present application assails the order passed by the learned Trial Court, whereby the anticipatory bail application filed by the applicants for the offences under Sections 191(2), 191(3), 190, 115(2), 126(2), 351(2), 352, 117(2), 118(1), and 110 of the BNS, 2023, was dismissed. 2. At the outset, learned counsel for the accused-applicants has submitted that the present matter is a case of cross-FIRs, wherein both the rival parties have lodged criminal cases against each other. It is submitted that similarly situated co-accused persons, namely Rohitash, Monu, and Manish, whose cases stand on an identical footing, have already been granted the concession of anticipatory bail by the Coordinate Bench of this Court vide order dated 28.10.2025. It is further submitted that some of the applicants are senior citizens, aged about 62 and 73 years, and that except for the applicant Babulal, there are no criminal antecedents registered against the remaining applicants. 3.
Per contra, learned Public Prosecutor has vehemently opposed the instant anticipatory bail application. It is submitted that a specific role of causing injury has been assigned to the applicant Ganesh, and that there is one criminal antecedent registered against the applicant Babulal, and therefore, the concession of anticipatory bail should not be granted. Having heard the contentions put forth by the counsel representing the parties and upon an assiduous scanning of the material available on record, taking note of the fact that the present is a case of cross-FIRs; that the case of the applicants, except the two applicants, namely Ganesh and Babulal, stands on the same footing as that of the co-accused who have already been granted the concession of anticipatory bail; that there are no criminal antecedents pending against them, and looking to the overall facts and circumstances of the case but without commenting on the merits/demerits of the case, this Court is inclined to allow the anticipatory bail application qua the applicants other than Ganesh and Babulal. 5. Accordingly, the present anticipatory bail application is allowed.
The S.H.O/I.O/Arresting Officer, Police Station Bandikui, Dausa in F.I.R. No. 112/2025 is directed that in the event of arrest of the accused-applicants- Golu @ Gajendra S/o Kajod, Motilal S/o Chotelal, Suresh S/o Babulal, Premprakash @ Babulal S/o Kajod, Kajod S/o Tundaram, Raju S/o Babulal, they shall be released on bail, provided they furnish a personal bond in the sum of Rs.50,000/-each with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the applicants shall make themselves available for interrogation by a police officer as and when required; (ii) that the applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case
[2026:RJ-JP:13332] (4 of 4) [CRLMB-2290/2026] so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the applicants shall not leave India with out prior permission of the Court. 6. However, considering the specific allegations of causing injury attributed to applicant-Ganesh and taking note of the criminal antecedent registered against applicant-Babulal, this Court is not inclined to grant them the concession of anticipatory bail. 7. Accordingly, the instant anticipatory bail application is partly allowed. The anticipatory bail application qua the applicants namely, Ganesh and Babulal is dismissed. (SAMEER JAIN),J PARSHANT /25
