Heard Mr. R. Ingo, learned counsel for the petitioners. Also heard Mr. M. Kato, learned DySGI for the respondent Nos. 1, 3 & 4 as well as Ms. G. Ete, learned Additional Senior Government Advocate for the respondent No. 2.

The petitioners are students who have jointly filed this petition jointly seeking a direction to the respondent authorities to correct the erroneous Dates of Birth recorded in their respective Aadhaar Cards on the basis of their Birth Certificates, CBSE/School records and other supporting documents.

The grievance of the petitioners is that although their correct Dates of Birth are reflected in their Birth Certificates and educational records, incorrect entries have been recorded in their Aadhaar Cards due to inadvertent errors during enrolment/update. It is stated that the petitioners had approached the concerned authorities for correction of the said entries; however, the requests could not be processed as the permissible limit for updating the Date of Birth had already been exhausted. Thereafter, the petitioners submitted representation dated 15.07.2026 before the respondent authorities along with the relevant supporting documents, but no decision has been taken till date.
4. Having regard to the nature of the relief sought and as agreed to by the
learned counsel appearing for the parties, the writ petition is disposed of at the motion stage itself.
5. Learned counsel for the petitioners submits that the writ petition may be
disposed of with a direction to the respondent authorities, more particularly, the respondent No. 4, to consider the representation dated 15.07.2026 submitted by the petitioners by verifying the Birth Certificates, CBSE/School records and other supporting documents produced by the petitioners and thereafter correct the Dates of Birth recorded in the Aadhaar Cards of the petitioners. 6. Mr. Kato, learned DySGI appearing for the respondent Nos. 1, 3 & 4, submits that he has no objection if the writ petition is disposed of with a direction to the respondent authorities to consider and decide the
Page No.# 6/7 representation dated 15.07.2026 submitted by the petitioners, after verification of the documents relied upon by them, in accordance with law. 7. Having considered the submissions made by the learned counsel for the parties and having regard to the limited prayer made by the petitioners, this Court deems it appropriate to dispose of this writ petition by directing the authorities to consider the grievance of the petitioner, in view of the provisions of Section 31 of the AADHAAR (Targeted Delivery of Financial And Other Subsides, Benefits and Services) Act, 2016, wherein it is provided as under:
“(1) In case any demographic information of an Aadhaar number holder is found incorrect or changes subsequently, the Aadhaar number holder shall request the Authority to alter such demographic information in his record in the Central Identities Data Repository in such manner as may be specified by regulations. (2) In case any biometric information of Aadhaar number holder is lost or changes subsequently for any reason, the Aadhaar number holder shall request the Authority to make necessary alteration in his record in the Central Identities Data Repository in such manner as may be specified by regulations. (3) On receipt of any request under sub-section (1) or sub-section (2), the Authority may, if it is satisfied, make such alteration as may be required in the record relating to such Aadhaar number holder and intimate such alteration to the concerned Aadhaar number holder. (4) No identity information in the Central Identities Data Repository shall be altered except in the manner provided in this Act or regulations made in this behalf.”

Accordingly, the petitioners are directed to appear before the respondent No. 4, namely, the Deputy Director General, UIDAI, Regional Office, Guwahati, Block-V, First Floor, HOUSEFED Complex, Beltola-Basistha Road, Dispur, Guwahati, within a period of one month from today, along with all necessary documents, including their Birth Certificates, CBSE/School records and other supporting documents, in support of their claim for correction of the Dates of Birth recorded in their respective Aadhaar Cards. 9. Upon such appearance, the respondent No. 4 shall afford an opportunity of
Page No.# 7/7 hearing to the petitioners and, after due verification of the documents produced by them, consider the grievance of correction of date of birth of the petitioners. The said exercise shall be completed within a further period of one month, from the date of appearance of the petitioners. 10. With the above observations and directions, the writ petition stands
disposed of.
