No. 22939 of 2026 ORDER: This writ petition under Article 226 of the Constitution of India is filed seeking the following relief:- “…to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in not releasing an amount of Rs.4,58,831/- to the petitioner for the execution of work, vide Agreement No. /2023-24, dated 04.03.2024, relating to “Laying of C.C. road from Racha to Nimala Ankamma (H) in S.T. Colony of Turimerla GP in Sydapuram Mandal” as arbitrary, illegal, contrary to law and against the principles of natural justice and against the norms of Public Policy and to issue consequential direction directing the respondent authorities to release the amounts payable to the petitioner with an interest at 18% per annum and to pass such other order or orders in the interest of justice.” 2. The case of the petitioner, briefly stated, is as follows:- a. The respondent No.3 / Executive Engineer, P.R.I. Division, Nellore, entrusted the following work to the petitioner. Colony of Turimerla G.P in Sydapuram Mandal” Agreement No. / 2023-24, dt.04.03.2024. M. Book No. 876-B / 2023-24, HIW ID/ Work ID No. PR – 5185-36718 Rs.4,58,831/- 4 BSB, J W.P. No. 22939 of 2026 b. The petitioner executed the work within the stipulated time. Though the respondent authorities were satisfied with the execution of work, but failed to release the payment within time. Hence, this writ petition was filed. 3. The learned Assistant Government Pleader for Panchayat Raj & Rural Development placed on record a copy of the written instructions, dated 23.09.2026, wherein it was stated as follows:- “1. This work is admitted for payment. 2. There is no dispute for the amount claimed by the petitioner. 3. Six (6) months of time may be taken to arrange payment to the contractor.” 4. The learned counsels for both the parties requested to dispose of the writ petition in the light of the written instructions. 5. Having regard to the above submissions, the writ petition is disposed of directing the respondents to release the admitted amount of Rs.4,28,374/- (Four Lakh Twenty eight thousand three hundred and seventy four only) to the petitioner, along with interest as per the entitlement, within a period of one (1) month from the date of receipt of a copy of this order.
