HON'BLE MS. JUSTICE MADHU JAIN O R D E R % 06.07.2026
1. This hearing has been done through hybrid mode. 2. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), whereby the Petitioner seeks quashing of FIR No. 553/2020, registered at Police Station Farsh Bazar, Shahdara, Delhi, for the offences punishable under Sections 363/366 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom. 3. Issue notice. Learned Standing Counsel for the State accepts notice. 4. 5. Briefly stated, the Petitioner and Respondent No. 2 solemnized their marriage in the year 2022 in accordance with Hindu rites and ceremonies after Respondent No. 2 attained the age of majority. They have since been blessed with a daughter and are presently residing together happily as husband and wife. The parties have also entered into a Memorandum of Understanding (‘MOU’) dated 10.05.2026, whereby they have amicably resolved all their disputes and agreed to continue their matrimonial life peacefully. It is the case of the Petitioner that the present FIR came to be registered at the instance of the mother of Respondent No. 2, who was opposed to the marriage between the parties. 6. On a query put by this Court, Respondent No. 2, who has been duly identified by the IO, states that she has entered into the MOU out of her own free will and volition, that she is residing happily with the Petitioner, and that she has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed. 7. Considering that the Petitioner and Respondent No. 2 are living together as husband and wife, have been blessed with a daughter, have amicably resolved their disputes by way of the Memorandum of Understanding dated 10.05.2026, and Respondent No. 2 does not wish to pursue the present proceedings, no useful purpose would be served by continuing the criminal proceedings.
Continuation thereof would only disturb the settled matrimonial life of the parties and would not serve the ends of justice. 8. Accordingly, FIR No. 553/2020, registered at Police Station Farsh Bazar, Shahdara, Delhi, for the offences punishable under Sections 363/366 IPC, and all consequential proceedings emanating therefrom, are hereby This is a digitally signed order.
