2026:HHC:21794 IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA Execution Petition No. 69 of 2026 Decided on : 03.06.2026 Nira Devi Abrol …Petitioner Versus State of Himachal Pradesh and another …Respondents Coram The Hon’ble Mr. Justice G.S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Bipin C. Negi, Judge. Whether approved for reporting?1 For the petitioner : M/s Vinod Chauhan and Aanchal Singh, Advocates. For the respondents : Mr. Gobind Korla, Additional Advocate General. G.S. Sandhawalia, Chief Justice (Oral) After arguing for some time, counsel for the petitioner submits that he may be permitted to withdraw the present execution petition. Since apparently, it is clear from the representation, dated 29.08.2025 (Annexure E-5), that the pay scale of the petitioner was fixed at a lower side, which is stated to be in violation of law and procedure. 2. It is further noticed that even in the affidavit filed in the contempt petition, a reference has been made by the State to an order dated 17.05.2018, which has been appended as Annexure R- 1. 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:21794 3. The averments made in the execution petition are that similarly situated persons in Civil Writ Petition No. 7526 of 2021, titled as Laiq Ram Sharma and another Versus State of Himachal Pradesh and another, along-with other connected matters, decided on 17.10.2023 (Annexure E-6), have been granted reliefs by quashing similarly passed orders. 4. In such circumstances, present petition is not maintainable, since the respondents have apparently complied with the order, which is sought to be executed. 5. Resultantly, the execution petition is dismissed as withdrawn. However, it is open to the petitioner to take appropriate steps in accordance with law, if so permissible, at this stage. 6. Pending miscellaneous application(s), if any, also stand disposed of accordingly. (G.S. Sandhawalia) Chief Justice (Bipin C. Negi) Judge June 03, 2026 (Shivank Thakur)
