PROJECT, RAPUR AT NELLORE, MULAPETA, NELLORE, SPSR NELLORE DISTRIC-524003. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue appropriate writ order or direction more particularly a Writ of Mandamus declaring the action of the respondents in not paying the enhanced compensation for the lands and trees situated in Gundavolu Village Rapur Mandal, SPSR Nellore district, acquired by the State for public purpose under Telugu Ganga Project terms of Judgment passed by this Honble High Court dated 27.09.2023 in LAAS NO. 45 of 2019 in LAOP No.53 of 2002 as illegal, arbitrary, violative of Land Acquisition Act in article 300 of the Constitution of India and It is also just and necessary that this Honble High Court may be pleased to direct the respondents to pay/deposit the enhanced compensation amount in terms of Judgment passed by this Honble High Court dated 27.09.2023 in LAAS NO.
45 of 2019 in LAOP No.53 of 2002, pending disposal of the above writ petition and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay/deposit the enhanced compensation amount in terms of Judgment passed by this Hon’ble High Court dated 27.09.2023 in LAAS NO. 45 of 2019 in LAOP No.53 of 2002 pending disposal of the above writ petition and pass Counsel for the Petitioner:

ORDER
Heard Sri M.Desaradha Rami Reddy, learned counsel for the petitioner, Ms.Anusha, learned Assistant Government Pleader for Land Acquisition for the respondents 3, 5 to 7, Sri T.S.Rayulu, learned Government Pleader for Irrigation for the respondents 1 & 4 and Sri Somaraju, learned Assistant Government Pleader for Finance for the 2nd respondent.
2. The above writ petition is filed to declare the action of respondents in not paying enhanced compensation for land and trees, in terms of order dated 27.09.2023 in LAAS No.45 of 2019 and batch, as illegal and arbitrary.

Learned counsel for the petitioner would submit that having been not satisfied with the quantum of compensation awarded, the petitioner along with others filed appeals. The Division Bench of this Court vide common judgment, allowed the appeals enhancing the compensation in respect of trees only and the compensation in respect of land has not been enhanced.
4. As seen from the common judgment dated 27.09.2023, in the above appeals, the Division Bench of this Court held at Para-9 thus:
9) As regards the compensation for each tree is concerned, in view of the judgment of the Division Bench of this Court rendered in L.A.A.S. No.120 of 2015, dated 04.08.2023, the compensation for each tree is enhanced as infra. Mango, Acid Lime, Coconut, Guava, Jack-fruit & Sapota 3 (Sapodilla)

Rs.6,000/- per tree Cheeni (Sweet Orange
Rs.4,000/- per tree Soap-nut
Rs.5,000/- per tree Pomegranate

Learned counsel for the petitioner would submit that no appeal was filed by the Government against the common judgment in LAAS No.45 of 2019 and batch.
5. Ms.Anusha, learned Assistant Government Pleader for Land Acquisition, while admitting the entitlement of the petitioner for enhanced compensation, seeks two months to pay the enhanced compensation.
6. Given the facts and circumstances of the case, the Writ Petition is
disposed of, directing the respondent authorities to pay the enhanced compensation to the petitioner, as per his entitlement, in terms of the common
judgment in LAAS No.45 of 2019 and batch dated 27.09.2023, within a period of two months from the date of receipt of a copy of this order. No order as to costs.
As a sequel, all the pending miscellaneous applications shall stand closed.
