3. “The present writ petition has been filed challenging the notices dated 8th July, 2025 (Annexure P-1), 16th April, 2026 (Annexure P-2), 30th April, 2026 (Annexure P-3), issued by the respondent no.1/DDA notifying the removal of illegal encroachments from the protected Zone-O.
4. It is the contention of the petitioners that the properties of the petitioners fall in Zone-F and not in Zone-O. In this regard, representations have been made to the respondent no.1/DDA on 5th June, 2026 (Annexure P-14 in W.P.(C) 8280/2026. A further direction is sought in the writ petition that the aforesaid representations be decided. 5. Per contra, Ms. Prabhsahay Kaur, counsel appearing on behalf of the respondent no.1/DDA submits that the properties of the petitioners fall within Zone-O and this has been established on account of demarcation done by DDA through drone survey. It is further submitted that the subject notices have been issued pursuant to orders passed by a Special Bench of this Court in W.P.(C) No. 5751/2014 titled ‘Vijay Kumar Divakar v. South Delhi Municipal Corporation’. 6. Without prejudice to the rights and contentions it is directed that the respondent no.1/DDA shall consider the representations filed on behalf of the petitioners on 5th June, 2026, after according a personal hearing to the petitioners and passing a speaking order. 4.1. at 3:00 PM before the Office of Director/Deputy Director, Land Management, DDA, Vikas Sadan, Delhi. 4.2. The petitioners in both the writ petitions shall be represented by Mr. Mohd. Ashraf Farooqui, Advocate & Mr. Kamran Malik, Advocate. 7.
In my considered view, the principles of natural justice require that reasonable time be given to the petitioner to invoke remedies that may be available in law, against the order to be passed by DDA. 8. Accordingly, the present petition is disposed of, while directing that in the event a speaking order passed by DDA is against the petitioner, no coercive steps shall be taken for a period of three (3) working days in
order for the petitioner to avail appropriate remedies in law.
