ORDER
Heard Sri V.V.Satish, learned counsel for the petitioner and Sri Divya Theja, learned Assistant Government Pleader for Revenue for the respondents.

Learned counsel for the petitioner would submit that the petitioner purchased an extent of Ac.1.50 cents in S.No.85/C of Potturu village, Guntur under a registered sale deed dated 08.07.2002, document No.2472 of 2002, from Chimata Sankara Rao and Chimata Varadarajulu. The vendor of petitioner Ch. Sankara Rao purchased an extent of Ac.0.50 cents from Dupati Krishnavenamma and her two sons under a registered sale deed dated 04.04.1988, document No.797 of 1988. Chimata Radhamma, who is the wife and mother of his vendors, purchased Ac.1.00 cents from Jaladi Venkata Subbaiah under a registered sale deed dated 10.02.1984 vide document
No.1209 of 1984. Petitioner’s sale deed and other linked documents are filed as Exs.P1 to P5. The 1st respondent issued G.O.Ms.No.197, Revenue (Assn.I) Department, dated 05.05.2016 (Ex.P7), notifying the lands under Section 22- A(1) (e) of the Registration Act, 1908, wherein S.No.85/C was enlisted as S.No.999 as “Dots in RSR”. Later, the Government issued G.O.Ms.No.89 Revenue (Lands.V) Department, dated 02.03.2023 (Ex.P10), whereby the classification was changed from 22-A(1)(e) to 22-A(1)(a),(b),(c),(d). He would submit that, in fact, the petitioner made an application to delete the property from the prohibited properties list. He would also submit that as per the table filed at Page No.71 of the writ papers, the Revenue Divisional Officer, Guntur, recommended the case of the petitioner; however, the property has not been deleted so far from the list of prohibited properties. He would submit that the petitioner made an application (Ex.P12) to delete the property from the list of prohibited properties; however, the authority failed to consider the same. 3. Sri Divya Theja, learned Assistant Government Pleader for Revenue for the respondents, submitted the instructions of 2nd respondent-District Collector, wherein it was stated thus:
“2 (i). Previously, Sri Alla Sambasiva Rao has filed an application vide No.TTA012600140838 dated 28.03.2026 through Mee-seva requesting to delete the land to an extent of Ac.1.50 cents situated in Sy.No.85/C of Pothuru village of Guntur West Mandal from the prohibited properties list held u/s 22-A(1)(a) of the Registration Act, 1908.
ii) In pursuance thereof, after xamining the report of the Revenue Divisional Officer, Guntur vide Rc.No.824/22026-H, Dated 18.05.2026, the District Collector, Guntur issued proceedings vide Rc.No.975(P)/2026-E2, Dated 29.05.2026 duly rejecting the application filed by the petitioner advising him to file fresh application as per the provisions of the A.P Dotted Lands (Updation in Re-Survey and Settlement Register) Act, 2017 since the subject land is classified as Dotted land. 3) Subsequently, the writ petitioner has filed an application through online vide application No.DTL260518025193 Dated 18.05.2026 seeking for deletion of the subject land as per A.P Dotted Lands (Updation in Re- Survey and Settlement Register) Act, 2017. The application will be decided after examining statutory provisions of the A.P Dotted Lands (Updation in Re-Survey and Settlement Register) Act, 2017 since the subject land is classified as Dotted lands within three months.”

Since the petitioner made an application on 18.05.2026, the 2nd respondent-District Collector shall consider the same and pass appropriate orders in respect of Ac.1.50 cents in S.No.85/C of Potturu village, Guntur (West) Mandal, Guntur District. The 2nd respondent shall consider the material filed along with writ petition vide Exs.P1 to P10, while considering the request of the petitioner. The 2nd respondent shall afford an opportunity of hearing to the petitioner and pass appropriate order strictly as per law, within a period of two months from the date of receipt of a copy of this order. 5. Accordingly, the Writ Petition is disposed of. No order as to costs.
