26 Heard Ms. N. Begum, learned counsel for the petitioner and Mr. K. K. Parashar, learned Additional Public Prosecutor, Assam.
2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Mr. Kushal Thakuria, who was arrested on 24.10.2024 in connection with Sessions Case No. 08/2025 corresponding to Palashbari P.S. Case No. 418/2024 registered under Sections 49/103(1)/3(5) of the BNS.
3. Scanned copy of the TCR has been received and perused the same.
4. This is the second bail application in respect of the petitioner, whose earlier bail application was rejected on 06.02.2026, passed in BA No. 30/2026.
5. Upon perusal of the TCR, there appears to be incriminating materials against the petitioner and the alleged offence is also heinous in nature. However, the petitioner has already spent more than 600 days in custody and it appears that out of 18 witnesses, only two witnesses have been examined till date and expectedly, the trial will take time to conclude.
6. Having regard to the above, the prayer for bail is allowed.
7. Accordingly, the petitioner, named above shall be released on bail on furnishing a bond of Rs. 50,000/- (Rupees Fifty Thousand) only with two sureties of the like amount to the satisfaction of the learned Trial Court in connection with the aforementioned case with the following conditions: (i) The accused person shall not abscond and he shall be available for the
Page No.# 3/3 remaining trial; (ii) He shall not hamper or tamper with the evidence; (iii) He shall not in any manner intimidate, harass or try to influence any witnesses.
8. Violation of the bail conditions would lead to cancellation of the bail.
9. The bail petition stands allowed and disposed of.
