This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Uttam Kaibarta, who was arrested on 05.06.2026 in connection with Palashbari P.S. Case No. 130/2026 registered under Sections 303(2) of BNS, 2023, read with Section 11(1)(d)(e) of the Prevention of Cruelty to Animals Act, 1960, read with Section 13(1)/16 of the Assam Cattle Preservation Act. 3. The case diary as called for has been received and perused the same. 4. It is submitted that the petitioner is the driver-cum-owner of the vehicle, but not of the seized cattle. It is also submitted that the cattles are not stolen and in support of the said contention, some receipts have also been annexed with the petition. 5. Be that as it may, having regard to the fact that the petitioner had spent 54 days behind bars, the prayer for bail is allowed. 6. Accordingly, the above-named petitioner is allowed to go on bail of Rs.50,000/- (Rupees Fifty Thousand) only with 2 (two) sureties of like amount subject to the satisfaction of the learned CJM, Kamrup, Amingaon with following conditions: (i) That the petitioner shall not hamper with the investigation, or tamper Page No.# 3/3 with the evidence of the case. (ii) That the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. (iii) That the petitioner shall not commit any offence while on bail. 7. Violation of bail conditions might entail cancellation of the bail. 8.
