No.542 dated 31.12.2013 issued by the 2nd respondent quash the same and direct the respondents 3 to 5 to cancel the Subdivision and remove the encroachments made on the Oodaiporamboke, which is situated in new S.Nos.1/1, 2/2 to the total extent of 3.22.50 hector in Pudhupeerkadavu Village, Sathyamangalam Taluk, Erode District from the encroachment of Special Task Force based on the petitioner representation dated 08.09.2022 For Petitioner : Mr.N.Vijayakumar For Respondents : Mr.T.Arun kumar AGP ORDER (Order of the Court was made by S.M.Subramaniam J.) The Writ Petition has been filed challenging the Government Order issued in G.O.Ms.No.542 dated 31.12.2013. 2. The Government transferred the subject land for the benefit of Special Task Force to conduct training programs. The subject land is now being used by the Special Task Force for imparting training to the personnels. Therefore, there is no encroachment of Government land. 3. The learned counsel for the petitioner would submit that on account of occupation of Special Task Force, water flow from the canal is obstructed. 4. The learned Additional Government Pleader would oppose by stating that it is only a training centre administered by the Special Task Force and there is no reason what so ever to cause obstruction to the free flow of water https://www.mhc.tn.gov.in/judis WP No. 3588 of 2023 __________ Page3 of 7 in the canal. The report filed by the Tahsildar would speak about the training programs and the reasons for issuance of G.O.Ms.No.542 dated 31.12.2013 by the Government. The relevant portion of the report reads as under:- As per the G.O.(Ms.)No.822 Home (Police X) Department dated 24.11.2016, it was accorded for the construction of the Dog Kennel for Special Task Force in the Survey No.140/3 to an extent of 1.91.00 Hectares of Pudupeerkadavu Village. The residual portion of the lands are used for the purpose of Training to the STF officials. Still the STF is in operation. It is very pertinent to state before passing the G.O.542 dated 31.12.2013 that the Tamil Nadu Special Task Forced having head quarter at Erode is functioning in the Building of S.S.Mahal which was owned by a private person situated near to Sathyamangalam village, Sathyamangalam Taluk, Erode District. After the shot down of Veerappan and his colleagues on 18.10.2004, the Government has ordered in the G.O. (Ms.)No.1358 Home (Police-VIII) dated 06.12.2004 to function of the Special Task Force continuously by creating additional post of one Additional Superintendent of Police, one Deputy Superintendent of Police and one Photography Unit. Accordingly Nine Campus have been setting up having with head quarter at Sathyamangalam involving the task to apprehend Naxalite extremists, Maoist extremists, Forest offender, Train burgler, Flight Hijackers, offenders involved in kidnapping prominent persons and demanded ransom. After the shot down Veerappan and his colleagues it was learnt that in the thick forest around 6600 square kilometer there is no sufficient and suitable space for staying the trainer continuously and impart the training. After that the Tamil Nadu Special Task https://www.mhc.tn.gov.in/judis WP No. 3588 of 2023 __________ Page4 of 7 Force was changed as Full Time Training Centre as Jungle Survival and Warfare Training Centre to impart the training in connection with preserve the forest, to vigil the naxalites not to enter into the forest and imparted training to the 11880 personnel’s of Police Department and Forest Department. Since there is no sufficient space for imparting training for the above personnel, it is in compulsion to depute the trainees to somewhere else it has to face difficulty for the vehicles access to the training centre and also meet out other difficulties. Therefore if 100 acres of suitable land is available in the Sathyamangalam Taluk it will be enabled to set up the training Centre for Jungle Survival and Warfare training to the Tamil Nadu Special Task Force. There are the lands with an extent of 10.46.70 hectare (25.85 acres) of Government Poramboke bearing R.S.No.1/1, 2/2, 124/1, 124/2, 124/3, 125/2, 126 and 140/2 of Pudupeerkadavu Vilalge, Sathyamangalam Taluk, Erode District. The lands are situated at the left side of Highways Road in the route of Rajan Nagar to Bannari in Forest Area. A proposal has been sent to the District Collector, Erode for Land Transfer of the above lands with an extent of 10.46.70 Hectares (25.85 acres). It was confirmed that the above extent of 10.46.70 Hectares (25.85 acres) is very suitable to set up Jungle Survival and Warfare Training Centre enabling for impart training for Jungle Survival and Warfare Training, Training Office, accommodation for trainees, Kitchen, Dining Hall, Store Room for keeping arms and vehicle parking shed. It was conditioned in the para 7(ii) of the G.O.No.542 that if the entire land or a portion of the land transferred to the Requisition Department (STF) is not further need in future, the land or portion should be handed over the Revenue https://www.mhc.tn.gov.in/judis WP No. 3588 of 2023 __________ Page5 of 7 Department. It was also conditioned in the para 7(ii) of the G.O.No.542 that the land should be used only for what purpose the land was transferred. 5. The Government Order impugned issued in G.O.(Ms.) No.542 dated 31.12.2013 stipulates conditions and condition No.6 would say that no changes or alteration will be made in respect of the canal running through the subject property and the said canal is to be maintained as canal by the Special Task Force. This being the condition imposed in the Government Order, the respondents are bound to maintain the canal as canal for the free flow of water, so as to protect the interest of the farmers and the people residing in that locality. Since the grievance of the petitioners are protected under clause No.6 of the impugned G.O.(Ms.) No.542 dated 31.12.2013, no further adjudication is required. 6. Consequently, the Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions are closed. (S.M.S.,J.)
