Petitioner has filed this writ petition seeking following reliefs:- “10.1. This Hon’ble Court may kindly be pleased to direct the respondents, to consider the claim of petitioner for grant of family pension, leave encashment and other service benefits of the her husband. 10.3. That, this Hon’ble Court may kindly be pleased to direct the respondent no.2 to consider and decide the petitioner dated 18.08.2025 within stipulated period. 10.4. Any other relief/reliefs which may deem fit and proper in the facts and circumstances of the case, may also be granted in favour of the petitioner.” 2. Learned counsel for petitioner would submit that husband of petitioner was working as JCB Operator under respondent No.2 on daily wages. Petitioner’s husband died on 27.8.2023, however, petitioner has not been paid any service benefits after the death of her husband. Petitioner submitted representation before respondent No.2 on 18.8.2025, which is still pending consideration. He submits that in view of decision of the Division Bench of this Court dated 26.2.2015 in WA No.281/2013 as also order of learned Single Judge in WPS No.3478/2020 decided on 6.3.2025, petitioner is entitled for pensionary benefits of her deceased husband. Therefore, he prays that this writ petition may be disposed of by issuing a direction to respondent No.2 to consider and decide pending representation of petitioner expeditiously. 3. Learned State Counsel submits that main grievance of petitioner is against respondent No.2 Municipal Corporation for whom he 3 is not appearing. 4. Learned counsel for respondent No.2 submits that he is not having any objection to the limited prayer made by learned counsel for petitioner. If representation of petitioner is still pending consideration, it will be decided in accordance with law. 5. Heard learned counsel for respective parties and perused the documents annexed with writ petition. 6. Considering the submission of learned counsel for respective parties, this writ petition, without entering into merits of claim of petitioner, is disposed of at this stage with a direction to respondent No.2 to consider and decide pending representation of petitioner dated 18.8.2025 (Annexure P-5), if already not decided, in accordance with law expeditiously, preferably within a period of five months from the date of receipt of order. 7.
