Mr. Pranav Sharma, learned counsel for the respondent at the outset has produced order dated 11.05.2026 passed learned Special Railway Mobile Magistrate, Jammu in an application under Section 23 of Protection of Women from Domestic Violence Act, whereby the learned trial Court on the application of petitioner No. 3 herein namely Geeta Devi has passed the following order “Viewed thus, the non-applicants are directed not to commit any act of domestic violence upon the applicant and further non-applicant Nos. 2 and 3 are temporarily restrained from entering into the residential house of the applicant without the consent of the applicant till next date of hearing, further meanwhile, the non-applicant No. 4 shall make endeavour to arrange the rental accommodation for respondent No. 1 in order to avoid any undue incidents.” 2. The order dated 11.05.2026 is taken on record. 3. Learned counsel for the respondent submits that the conduct of the petitioner No. 3 disentitles her interim as well as final relief because she has resorted to forum shopping. Serial No. 59 2 CRM(M) No. 363/2026 4. Confronted with the aforesaid proposition, learned counsel for the petitioners seeks to withdraw the petition and further seeks liberty to approach the trial Court with a prayer for withdrawal of the proceedings pending in case file No. 218/2026. 5. The statement made by learned counsel is taken on record. He is at liberty to approach the trial Court, if so advised. 6. In view of the submissions made, this petition is dismissed as withdrawn. However, despite petitioners are permitted to withdraw the petition, but keeping in view their conduct, a note of caution is stuck to be careful in future. 7.
