JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 1. This application for bail under Section 483 BNSS (439 Cr.P.C.) has been filed by the petitioner who has been arrested in connection with F.I.R. No.216/2025 registered at Police Station Suratgarh City, District Sri Ganganagar, for offences under Sections 8/18 and 8/29 of the NDPS Act. 2. Counsel for the petitioner submits that petitioner has been falsely implicated. Recovery is of 59 Grams of Opium, which is less than commercial quantity. 3. Counsel submits that recovery has been affected from Sandeep and nothing has been recovered from the petitioner. It is alleged that the same was purchased from the petitioner. Furthermore, co-accused Sandeep has been enlarged on regular bail by this Court on 08.5.2025 vide S.B. Criminal Misc. Bail Application No.5423/2025. The petitioner is in custody since [2026:RJ-JP:36159] (2 of 2) [CRLMB-9536/2026] 07.07.2026. Trial of case is likely to take a long time, thus, prayed to enlarge him on bail. 4. Per contra, learned Public Prosecutor opposed the bail application stating one case under NDPS Act is pending against the petitioner. 5. This Court has considered the rival submissions, facts and circumstances of the case as well as perused the material available on record. 6. Looking to overall facts of the case and role assigned to the petitioner and further keeping in view of the fact that conclusion of trial of case is likely to take time and the prosecution has not shown any apprehension of petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. 7. Consequently, the bail application under Section 483 BNSS (439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner Manoj Singh S/o Shri Govardhan Singh arrested in connection with F.I.R. No.216/2025 registered at Police Station Suratgarh City, District Sri Ganganagar, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
