The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) This is a digitally signed order. Issue Notice. Learned APP for the State accepts notice. 8. The Petitioner and Respondent No. 2 are present before this Court and have been identified by the Investigating Officer (IO) concerned. 9. Briefly stated, on 23.10.2014, an unfortunate accident took place when the minor daughter of Respondent No. 2 sustained fatal injuries while the Petitioner was reversing his vehicle. Pursuant thereto, the aforesaid FIR came to be registered against the Petitioner. During the pendency of the proceedings, with the intervention of family members and common relatives, the parties amicably resolved all their disputes and entered into a Settlement/Compromise Deed dated 04.12.2025. 10. It is submitted that, in terms of the settlement, the agreed payment has been made in cash by the Petitioner to Respondent No. 2. 11. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, categorically states that he has entered into the settlement out of his own free will, without any force, coercion or undue influence. He further states that he has received the settled amount in terms of the settlement and has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed. 12. In view of the fact that the parties have amicably resolved their disputes and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served by continuing the present criminal proceedings.
