Learned counsel for the petitioner submitted that the contraband recovered from the petitioner and three other persons is 40.410 kg of poppy straw/husk, which is below the commercial quantity. So far as the criminal cases pending against the petitioner are concerned, he has already been acquitted by the learned trial Court in two cases. At present, about five criminal cases are pending against the petitioner; however, he
[2026:RJ-JP:37782] (2 of 3) [CRLMB-8240/2026] has not been convicted in any of them. Learned counsel further submitted that the petitioner has been in judicial custody since
07.04.2026. After completion of the investigation, the charge- sheet has also been filed, and as the trial is likely to take a considerable time to conclude, the petitioner deserves to be enlarged on bail. Per contra, learned Public Prosecutor has opposed the bail application. This Court has considered the rival submissions, the facts and circumstances of the case, and has also perused the material available on record. The contraband recovered from the petitioner and three other persons is 40.410 kg of poppy straw/husk, which is below the commercial quantity. It is also submitted that the petitioner is an addict and consumes the same. So far as the criminal cases pending against the petitioner are concerned, he has already been acquitted by the learned trial Court in two cases. At present, about five criminal cases are pending against the petitioner; however, he has not been convicted in any of them. The petitioner has been in judicial custody since 07.04.2026, and after completion of the investigation, the charge-sheet has also been filed. Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the narcotic contraband alleged to be recovered from the petitioner is below commercial quantity; the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any
[2026:RJ-JP:37782] (3 of 3) [CRLMB-8240/2026] opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. Consequently, the bail application under Section 483 BNSS (439 Cr.P.C.) is allowed.
