Through the present petition, the petitioner assails the order dated 21.05.2026 passed by the learned District Judge, West, Tis Hazari Courts, in CIV DJ 492/2026, titled as “Rajender Kharra vs. Delhi Urban Shelter Improvement Board”, whereby notice was issued on the petitioner’s applications under Order XXXIX Rules 1 and 2 and Order I Rule 10 of the Code of Civil Procedure, 1908 (hereinafter “CPC”). 2. Learned counsel for the petitioner submits that the petitioner’s grievance is that the application under Order XXXIX Rules 1 and 2 CPC has not yet been consider, and there is an imminent apprehension that the respondent may proceed to take coercive action against the petitioner’s This is a digitally signed order. It is submitted that, in such circumstances, the very purpose of filing the application for interim relief, as well as the present petition, would stand frustrated. 3. Having regard to the aforesaid submission and the fact that the demolition is stated to be schedules for 10.07.2026, this Court deems it appropriate to request the learned Trial Court to take up the petitioner’s application under Order XXXIX Rules 1 and 2 CPC for consideration on a priority basis on 09.07.2026, subject to its convenience and the exigencies of its Board. 4. With the above observations, the present petition, along with all pending applications, if any, stands disposed of. 5. It is made clear that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties are left open. 6.
