Learned counsel for the petitioner submits that without adhering to the policy decision taken by the respondents to keep husband and wife at one place of posting, the petitioner has been transferred from Govt. Sr. Sec. School, Bawalwada, District Udaipur to Govt. Sr. Sec. School, Devaliya, District Salumber which is about 280 kms away. He submits that the wife of the petitioner is also a Govt. servant and is working at District Udaipur. Learned counsel submits that the petitioner may be permitted to file a representation before the respondents which may be directed to be decided expeditiously.
2. Aforesaid contentions were opposed by learned AGC appearing on behalf of the respondents and he submits that due
[2026:RJ-JP:38075] (2 of 2) [CW-18423/2026] to administrative exigency the transfer has been effected but considering the grievance as raised by the petitioner, the petitioner is free to make a representation before the Grievance Committee constituted vide office order dated 17.07.2026 for resolving the issues pertaining to single women/widow/divorcee/ employees suffering grave illness and many other issues. He submits that the petitioner can file her representation before the Grievance Committee, which will consider the representation on the grounds raised by the petitioner in an expeditious manner and this petition can be disposed at this stage.

Taking into consideration the submissions advanced and also the fact that a Grievance Committee has been constituted vide office order dated 17.07.2026, this Court deems it appropriate to direct the petitioner to file representation Committee within a period of seven days from today and the Committee shall decide the representation within a period of fifteen days thereafter, strictly in accordance with law by way of passing a speaking order.
5. Till the decision of the representation, the impugned order dated 10.07.2026 (Annex.4) shall remain stayed qua the petitioner, in case, the petitioner has not joined at the new place of posting.
6. It is made clear that if the petitioner fails to file the representative within a period of seven days from today, the interim order granted by this Court shall stand vacated automatically.
7. With the aforesaid directions, the writ petition is disposed of. Stay application and pending application, if any, also stand
disposed of.
