Tripathy, AGA CORAM: THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY ORDER 11.02.2026 Order No. 01 1. This matter is taken up through hybrid mode. 2. Learned counsel appearing for the Petitioner contended that on the face of the pendency of the vigilance proceeding against the Petitioner where the trial is going on in Dhenkanal Vigilance P.S. Case No.4 dtd.30.04.2025, the disciplinary authority is proceeding with the proceeding initiated under Annexure-2. 3. It is contended that Petitioner will be seriously prejudiced if the disciplinary proceeding is disposed of, prior to disposal of the vigilance proceeding, which has been initiated on the self-same charges. 4. Learned Addl. Govt. Advocate for the State on the other hand contended that there is no bar for continuance of both the proceedings even though the charges are same. 5. Having heard learned counsel appearing for the Parties and considering the submissions made and the fact that both the proceedings have been initiated on self-same charges, this Court while disposing the Writ Petition, observes that the disciplinary Page 2 of 2. proceeding may continue but no final order will be passed, till disposal of the vigilance proceeding. Learned Vigilance Judge is directed to expedite the trial of Dhenkanal Vigilance P.S. Case No.04 dtd.30.04.2025. 6. With the aforesaid observations and directions, the Writ Petition stands disposed of. (BIRAJA PRASANNA SATAPATHY) Judge Jyoti
