CIVIL APPLICATION (REVIEW) NO. 646 OF 2026 IN WRIT PETITION NO. 2584 OF 2010(D) (Umesh s/o wamanrao Rahate and anr Vs. The State, thr Secretary,Dept. Of Industries, energy and Labour, Mantralaya, Mumbai 32 and ors) __________________________________________________________________________________________ Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders __________________________________________________________________________________________ Mr. S.R. Badana, Advocate for petitioners. Mr. D.P. Thakare, Addl. GP for respondent Nos. 1 to 3/State. CORAM : ANIL S. KILOR & RAJNISH R. VYAS,JJ. DATE : 23/09/2026 Heard. 2. This Court, vide its order dated 20.8.2026, had permitted the petitioners to withdraw the petition with liberty to approach the Tribunal by filing Review Application and the petition was disposed of accordingly. 3. Now, the petitioners have approached this Court by preferring application for modification/clarification. It is submitted that after passing of an order on 20.8.2026, when the applicants approached the Maharashtra Administrative Tribunal, Mumbai, Bench at Nagpur, for filing the Review Application in the light of order dated 20.8.2026, the Registry of the Tribunal at Nagpur had raised an objection that since, the order of which review was sought, was passed by the Maharashtra Administrative Tribunal, Mumbai, therefore, Review Application needs to be filed at Maharashtra Administrative Tribunal, Mumbai. It is further submitted that at the relevant time i.e. in the year 1992, when the original order was passed by the Maharashtra Administrative Tribunal, Mumbai, the Belkhede 2026:BHC-NAG:12739-DB 2 102mca646.2026.doc Bench at Nagpur was not formed. Therefore, prayer is made that in view of formation of Maharashtra Administrative Tribunal, Bench at Nagpur, the order dated 20.8.2026 be clarified by stating that the applicants were granted liberty to approach the Maharashtra Administrative Tribunal, Mumbai, Bench at Nagpur. The aforesaid aspect is not disputed by the respondents. 4. Since prayer is innocuous, we clarify that vide order dated 20.8.2026, the petitioners were granted liberty to approach the Tribunal by filing Review Application, which would mean the Maharashtra Administrative Tribunal, Mumbai, Bench at Nagpur and not the Maharashtra Administrative Tribunal, Mumbai. 5. The Review/Clarification Application is disposed of in the aforestated terms. (RAJNISH R. VYAS, J.) (ANIL S. KILOR, J.) Belkhede Signed by: Mr. R. S.
