Petitioner has filed this petition seeking following relief (s) :- “10.1 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ by directing the respondent authorities to consider the case of the petitioner for grant of remaining gratuity amount equivalent to petitioner’s three and half months last drawn salary along with interest of 12% from the date of retirement i.e. 30.09.2022 within two months from the date of order, in the interest of justice. OR In alternate, the petitioner may kindly be permitted to raise all disputes before the competent authority i.e. respondent No.4 to 7 by filing a representation and they may kindly be directed to take a decision on the representation of the petitioner as per law within six weeks from the date of order. 10.2 Any other relief which this Hon’ble Court may deem fit and proper in favour of the petitioner may kindly be passed. 10.3 Cost of the petition may be awarded.” 2. Learned counsel for petitioner submits that petitioner was working as Driver under work charged contingency paid employee establishment. He stood retired on 31.12.2022. Petitioner after his retirement was paid retiral dues, however, amount of gratuity has been paid less. For computing the amount of gratuity, only 16 and half months pay has been given to petitioner instead of 20 months according to circular issued by the State Government in this regard dated 13.06.2023, 3 therefore, direction be issued to respondents to pay the balance amount of gratuity within specified time frame. 3. Learned State counsel submits that petitioner has not submitted any representation before the concerned authority for redressal of his grievance. 4. At this stage, learned counsel for petitioner submits that she may be permitted to submit representation before respondents No.7 & 8 and a direction be issued to concerned respondents to take decision on the claim of petitioner at the earliest within specified time frame. 5. On due consideration on the submission of learned counsel for parties, nature of grievance raised, this writ petition at this stage is disposed of permitting petitioner to submit comprehensive representation before respondents No.7 & 8 and if such representation is submitted, concerned authority shall consider and take decision on the representation to be submitted by petitioner in accordance with law expeditiously preferably within further period of three months from the date of receipt of representation along with this order. 6.
