Virender Singh, Judge (Oral) The   present   petition   has   been   filed   with   the following prayer:­ “(a) The petition may kindly be allowed and order dated 18.09.2025 passed by the learned trial Court (Senior Civil Judge), Theog, Shimla, District Shimla, H.P., in Execution Petition   bearing   No.   7­10   of   2009,   titled   ‘Yuh   Krishan Versus Sunder Singh’, filed in case No. 82­1 of 2005 be set aside being unnecessary, further with a prayer to allow the petition  and may direct the learned Court below to implement/execute the Judgment and decree within two months against Respondent No.1.” 2. This relief has been sought on the ground that the application under Order 21 Rule 32(3) CPC for sale of the   property   of   the   JD   has   been   moved,   way   back   on 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:21236 18.09.2025   and   thereafter,   the   said   execution   was   listed before   the   learned   Executing   Court   on   18   occasions   for effective   adjudication,   but   said   application   has   not   been decided. 3. In such situation, without going into the merits of the case, the present petition is allowed, by requesting the Executing Court to decide the Execution Petition No. 7 – 10 of 2009, titled as ‘Yuh Krishan Versus Sunder Singh’, within a period of four months, from the date of receipt of this order. 4. Copy of this order be sent to learned Executing Court.  In addition to this, the petitioner is also at liberty to produce the downloaded copy of the order passed by this Court, on the next date of hearing, before the Executing Court. 5.
