Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to order respondents to add 20% of basic pay in pension from the date of retirement ie., 31.08.2020 as petitioner has worked for more than 5 years under PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 respondent No. 5 in non practicing post which is established from L.P.C. Annexure P-4. 10.2 That, cost of litigation and any other relief which the Hon’ble Court deems fit may kindly also be allowed.” 2. Learned counsel for petitioner submits that petitioner was appointed as Doctor “Pathologist” with the respondent-State and he stood retire from service after attaining age of superannuation on 31.08.2020. Petitioner during period of his service has not been granted benefit of ‘Non-Practicing Allowance’ for a period from 1989 to 1993-94 and therefore petitioner has submitted representation to Respondent No. 4 on 03.04.2025 which till date is pending consideration. Therefore, direction be issued to Respondent No. 4 to consider and pass appropriate order(s) on the representation. 3. Learned State counsel submits that as the petitioner is not pressing this writ petition on merits and only seeking direction to take decision on the pending representation, he is having no objection. 4. On due consideration of the submission of learned counsel for the respective parties, instead of seeking reply from the respondents, this writ petition at this stage is disposed of directing Respondent No. 4 to take decision on the representation submitted by petitioner dated 03.04.2025 on the claim as prayed for in this writ petition, in accordance with law, expeditiously preferably within a further period of 03 months from the date of receipt of copy of order passed by this Court. 5.
