JUSTICE BALJINDER SINGH SANDHU Order 05/08/2026 This application for bail under Section 483 BNSS (439 Cr.P.C.) has been filed by the petitioner who has been arrested in connection with F.I.R. No.14/2026 registered at Police Station Loonkaransar, District Bikaner, for offences under Sections 419, 420, 467, 468, 471 and 120-B IPC. Learned counsel for the petitioner submitted that the offences alleged against the petitioner are triable by the Court of Magistrate. It is submitted that the allegation is that the land in question was sold on the basis of a forged power of attorney in the year 2019, whereas the petitioner is only a subsequent purchaser under a sale deed executed in the year 2023. It is further submitted that the investigation in the matter stands concluded and the charge-sheet has already been filed. [2026:RJ-JP:36961] (2 of 3) [CRLMB-10202/2026] Learned counsel further submitted that the petitioner has been in judicial custody since 13.07.2026. Considering that the petitioner is a woman and the trial is likely to take considerable time to conclude, it is prayed that the benefit of bail be granted to the accused-petitioner. Per contra, learned Public Prosecutor has opposed the bail application. Learned counsel for the complainant has vehemently opposed the bail application. This Court has considered the rival submissions and perused the material available on record. The offences alleged against the petitioner are triable by the Court of Magistrate. The allegation is that the land in question was sold on the basis of a forged power of attorney in the year 2019, whereas the petitioner is a subsequent purchaser under a sale deed executed in the year 2023. The investigation in the matter stands concluded and the charge-sheet has already been filed. The petitioner has remained in judicial custody since 13.07.2026. Considering the nature of the allegations, the fact that the investigation is complete, and that the petitioner is a woman, this Court is of the opinion that the petitioner deserves to be enlarged on bail. Hence, keeping in view the facts and circumstances of the case; the alleged offences are triable by a Magistrate; and that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem [2026:RJ-JP:36961] (3 of 3) [CRLMB-10202/2026] it just and proper to grant bail to the petitioner under Section 483 of BNSS. Consequently, the bail application under Section 483 BNSS (439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner Savitri Devi W/o Shri Premsukh arrested in connection with FIR No.14/2026 registered at Police Station Loonkaransar, District Bikaner, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
