By the Court:- Heard the parties. 2. This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the prayer to quash and set aside the entire criminal proceedings of Kotwali (Sukhdeonagar) P.S. Case No.984 of 2013 corresponding to G.R. Case No.6075 of 2013 including the order taking cognizance dated 05.02.2014 passed in the said case. 3. Learned counsel for the petitioner submits that the case is next fixed to 22.04.2026 for appearance of the accused persons. It is further submitted that police after investigation of the said Kotwali (Sukhdeonagar) P.S. Case No.984 of 2013 submitted charge-sheet mentioning therein that the offence punishable under Section 498 of the Indian Penal Code is made out against the petitioner but in the cognizance order dated 05.02.2014 though the learned Chief Judicial

Magistrate, Ranchi in the first paragraph has mentioned that charge- sheet has been submitted under Section 498 of the Indian Penal Code but because of the apparent printing error, cognizance has been taken for the offence punishable under Section 498A of the Indian Penal Code instead of cognizance being taken of the offence punishable under section 498 of the Indian Penal Code. Hence, it is submitted that the cognizance order is not in accordance with law. It is lastly submitted that the prayer, as prayed for in the instant Criminal Miscellaneous Petition, be allowed. 4. Learned Addl. P. P. appearing for the State fairly submits that the same is a printing error. 5.
Considering the aforesaid facts, the order dated 05.02.2014 passed in connection with Kotwali (Sukhdeonagar) P.S. Case No.984 of 2013 corresponding to G.R. Case No.6075 of 2013 is set aside and the said case is remitted to the court of the learned Chief Judicial Magistrate, Ranchi to pass a fresh order in accordance with law. 6.
