The petitioner is apprehending his arrest in connection with Telaiya P.S. Case No.313 of 2025 for the alleged offences registered under Sections 272, 274, 275, 292 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a)(f) of Jharkhand Excise Act, pending in the Court of learned Additional Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioner submits during raid roof casting work of the house of the petitioner was going on and 40 to 50 masons as well as labourers were present there and the allegations are made that 40 liters country-made mahuwa liquor has been recovered from that place. He further submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.12 of the petition. He then submits that in the seizure list there 2026:JHHC:4509 --2-- A.B.A. No. 878 of 2026 is no independent witnesses. 4. Learned counsel appearing for the State opposed the prayer and submits that from the house of the petitioner said mahuwa liquor has been recovered. 5. Considering that the petitioner has got no criminal antecedent as disclosed in paragraph No.12 of the petition and it has been pointed out that on the fateful day 40 to 50 persons were working in the house as roof casting work was going on and in the seizure list there is no independent witnesses and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
