JUSTICE BALJINDER SINGH SANDHU Order 06/08/2026 In view of the directions dated 03.08.2026 passed by this Court in an identical matter being S.B. CRLMB No.3615/2026, both the officers, Dr. Shaloo Malik and Dr. Jaya Rathore, are [2026:RJ-JP:37123] (2 of 3) [CRLMB-4137/2026] present before this Court to assist the Court. The Court appreciates the assistance provided by both the officers. So far as the present case is concerned, the petitioners have been arrested in connection with FIR No. 46/2026 registered at Police Station Fatehnagar, District Udaipur, for the offences punishable under Section 8/22 of the NDPS Act. They have preferred these bail applications under Section 483 of the BNSS. Learned counsel for the petitioners submits that the alleged contraband of 13.90 grams of Mephedrone has been recovered, which is verified from the FSL report dated 14.05.2026, and the same is below commercial quantity. It is further submitted that there are no criminal antecedents of a similar nature against the petitioners and that they are in judicial custody since 25.02.2026. The trial is likely to take considerable time for conclusion. Per contra, learned Public Prosecutor has vehemently opposed the bail applications. This Court has considered the arguments advanced by learned counsel for the petitioners and finds that the alleged contraband of 13.90 grams of Mephedrone has been recovered, which is verified from the FSL report dated 14.05.2026 and is below commercial quantity. It is also noted that there are no criminal antecedents of a similar nature against the petitioners and that they are in judicial custody since 25.02.2026. Hence, keeping in view the overall facts and circumstances of the case; the fact that conclusion of the trial is likely to take time; the fact that the alleged narcotic contraband recovered from the [2026:RJ-JP:37123] (3 of 3) [CRLMB-4137/2026] petitioners is below commercial quantity; and the fact that the prosecution has not shown any apprehension of the petitioners fleeing from justice, in case they are enlarged on bail, but without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the petitioners under Section 483 of the BNSS. Accordingly, these bail applications filed under Section 483 of the BNSS are allowed. It is directed that the petitioners— Ganeshlal Alias Kaushal S/o Shri Udailal and Sampatlal S/o Shri Unkarlal—shall be released on bail in connection with the aforesaid FIR, if not wanted in any other case, provided they execute a personal bond in the sum of Rs. 1,00,000/- each with two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of the learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so, till completion of the trial.
