Ms. Sayanti Santra, Mr. Debarshi Brahma. ..for the State. Copy of Memo of Evidence filed in Court is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. However, the other co-accused were granted anticipatory bail by the Sessions Court. Charge sheet has been submitted. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the injury report and the statements of witnesses including that of the victim. It appears that the petitioner is the principal accused who hit the petitioner’s head with a spade causing lacerated injury. Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
