This is an application under Section 483 of the BNSS, 2023 praying for Page No.# 2/3 grant of bail to the accused person, namely, Sanuwar Hussain, who was arrested on 16.04.2026 in connection with Special NDPS Case No. 32/2026 arising out of Barpeta P.S. Case No. 116/2026 registered under Sections 21(b)/25 of the ND&PS Act, 1985. As per the allegations, on 16.04.2026, the petitioner was apprehended near Kapoha Bazaar and upon spot interrogation he revealed that he had concealed three soap boxes containing heroin at his hardware shop, which was searched and from where the contraband was recovered and the total weight of the same was found to be 31.69 grams, which falls in the category of intermediate quantity. It is submitted by learned counsel that, considering the fact that the co-accused in the case was granted bail by order dated 22.07.2026 in Bail Appln. 1895/2026 and considering the length of detention of 101 number of days, the prayer for bail may be considered Learned Addl. Public Prosecutor submits that unlike in the case of the co- accused, the recovery was made from the posession of the present petitioner. The case has already been charge-sheeted and having regard to the period of detention as well as the limited quantity of recovery, the prayer for bail is allowed on furnishing a bail bond of Rs. 50,000/- (Rupees fifty thousand only) with two sureties of the like amount subject to the satisfaction of the Page No.# 3/3 learned Special Judge, NDPS Barpeta/Addl. Sessions Judge, FTC, Barpeta, upon the following conditions that the petitioner shall regularly appear before the trial Court, once the trial commences and shall not try to influence the witnesses in any manner.
