By way of this application, the applicant is seeking bail in connection with Crime No.783 of 2026 registered with Washim Police Station, Washim for the offences punishable under Sections 109, 118(1), 117(2), 115(2), 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023. 3. The FIR came to be lodged by the injured victim alleging that the accused persons including the applicant have assaulted the informant and one another by means of knife, due to which they have sustained grievous injury, and others from informant’s party were also assaulted by the applicant’s party and therefore, the report. 4. The learned Counsel for the applicant submits that the applicant is 19 years of age. In the FIR, the name of the applicant is not disclosed. However, during the course of investigation, the name of the applicant came to be added. Even if the allegations made against the applicant are taken as it is, the only role attributed to 2026:BHC-NAG:12744 2 53.ba.1235.2026 him is of assault by fist and kick blows. He further submits that there are no criminal antecedents against the applicant, therefore, the applicant is prayed to be released on bail. 5. On the other hand, learned APP vehemently opposed the application by submitting that the applicant and other co-accused have beaten the injured by means of fist and kick blows. Though the role of the applicant is only to the extent of giving fist and kick blows, however according to learned APP, at present, the role cannot be segregated, since the charge sheet is yet to be filed. She submits that the injures are caused on vital parts of the body. Therefore, she prayed to reject the application. 6. Upon consideration of the submissions and after perusal of the FIR as well as case diary, it appears that the incident occurred as the friend of the informant was talking with one girl. So far as the FIR is concerned, the name of the applicant does not appear, however, during the course of investigation the name of the applicant surfaced. It is further to be noted that the role attributed to the applicant is only to the extent of giving fist and kick blows to the injured. 7. Considering the above facts and circumstances of the case, and the fact that the applicant is 19 years of age, the investigation is almost complete and that the applicant is not the author of the main injury, I am inclined to grant bail to the applicant. Hence, the following order. 3 53.ba.1235.2026 (a) The application is allowed. (b) The applicant Abhishek Ganesh Dhote in connection with Crime No.783 of 2026 registered with Washim Police Station, Washim for the offences punishable under Sections 109, 118(1), 117(2), 115(2), 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 be released on bail on furnishing P.R. bond of Rs.50,000/- with one surety in the like amount. (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence. (d) The applicant shall provide his residential address and cell number to Police Station concerned and shall not change his place of residence without prior intimation to the Investigating Agency. (e) The applicant shall attend each and every date of trial regularly. If he fails to attend the trial for one date, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail. 9. The observations are prima facie in nature and the Trial Court shall not be influenced by the same . 4 53.ba.1235.2026 10.
