JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:19668 WP No. 10106 of 2023 ORAL ORDER The present writ petition is filed seeking the following prayer: i. Issue a writ of mandamus directing the respondents to consider the representations as per Annexure-M & N and thereby issue caste certificates by incorporating as Dasari Caste which comes under Category-I OBC as per Annexure-P. ii. Issue any other appropriate writ, order of direction as this Hon’ble Court deems fit to grant under the facts and circumstances of the case, to meet the ends of justice and equity. 2. It is the case of the petitioner’s that the petitioners are the residents of Majara Kasaba Hobli, Bangarpet Taluk, Kolar District. The petitioner No.1 had studied primary school at the said village and studied 6th standard at Thattanahalli and his wife is uneducated and the children are studying now. Petitioner No.1 who had learnt to sign and also read & write in Kannada, filed an application to the Head Master of Lower Primary School, Thattanahalli to issue documents pertaining to school. The school had issued fee receipt dated 16.03.1963 and admission extract dated 02.08.2021, which reflects the caste as - 4 - HC-KAR NC: 2026:KHC:19668 WP No. 10106 of 2023 ‘Dasari’ in the said certificate. It is stated that for all practical purposes the petitioner requires a Caste Certificate. 3. The petitioner filed an application before the R- 3/Tahsildar at Bangarpet to issue the Caste Certificate. The said applications were rejected stating that the documents so produced along with the application do not have a valid and relevant proof to show that their caste is ‘Dasari’ and hence the said application cannot be considered for issue of caste certificate as sought for by the petitioner’s. As the R- 3/Tahsildar had not taken any action, the petitioner had submitted the representation to the R-2/Deputy Commissioner, Kolar and vide letter dated 09.06.2021 R-2/Deputy Commissioner had directed the R-3/Tahsildar to verify and issue caste certificate. It is submitted that the R-3/Tahsildar has not considered the same, which made him to come before this court. 4. Learned AGA appearing for R-2 & R-3 submits that in the light of the letter dated 09.06.2021, R-3/Tahsildar will consider the case of the petitioner in accordance with law. 5.Accordingly, this court is passing the following: - 5 - HC-KAR NC: 2026:KHC:19668 WP No. 10106 of 2023 ORDER i. The writ petition is disposed of directing the R-3/Tahsildar, Bangarpet to consider the case of the petitioner for issuance of caste certificate in the light of the letter dated 09.06.2021 within a period of three months from the date of receipt of the copy of the order. ii.
