At the outset, Mr. Pritish Sabharwal, SC for Respondent No. 1, raises a preliminary objection to the maintainability of the present writ petition. He submits that the controversy is governed by Statute 32 of the Indraprastha Vishwavidyalaya (First Statutes), 1998, framed under Section 26(1) of the Indraprastha Vishwavidyalaya Act, 1998. He draws the attention of the Court to Clause 17 thereof, which stipulates that the staff of the University shall retire on attaining the age of 60 years by way of superannuation. It is further submitted that, in terms of Clause 1.2, the said Statute applies to all employees of the University, other than teachers, and includes the post of Deputy Librarian. On the basis of a conjoint reading of the aforementioned provisions, he contends that, in the absence of any challenge to the vires of the said Statutes, the relief sought in the present petition cannot be entertained. 3. In view of the aforesaid preliminary objection, counsel for the Petitioner seeks leave to withdraw the present petition with liberty to file a fresh petition incorporating an appropriate challenge to the relevant provisions of the aforesaid Statutes. 4.
