By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks regular bail in connection with FIR No. 118/2023, dated 07.02.2023, registered at Police Station Subzi Mandi, under Sections 302 of Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959. 2. At the very outset, Dr. A.P. Singh, learned counsel for the petitioner, submits that the bail application of the petitioner was last dismissed by the Sessions Court vide order dated 08.04.2026. He submits that, in the meanwhile, evidence of nine material witnesses has concluded, and there are only two more material witnesses left, for which purpose the next date of hearing has been fixed on 05.08.2026, before the This is a digitally signed order. In view of the fact that this gives rise to a change of circumstances, Dr. Singh submits that instead of pressing the petition before this Court at this stage, the petitioner may be granted liberty to move the Sessions Court afresh, at the appropriate stage, and take all legal grounds available to him before the Sessions Court. 4. The petition is dismissed as withdrawn, with the aforesaid liberty. 5. It is made clear that this Court has not addressed itself to the merits of the case, and all right and contentions of the parties are left open.
