ORAL ORDER The writ petition is filed on the allegation that respondent No.3 has put up an illegal construction contrary to the building bye-laws and the sanctioned plan and that in spite of several complaints, the Bruhat Bengaluru Mahanagara Palike (for short, 'the BBMP') now, the Greater Bengaluru Authority (for short, 'the GBA') has not taken any action.
2. The learned counsel appearing for respondent No.3 is absent.
3. The learned counsel appearing for respondent Nos.1 and 2, upon instructions, submits that suitable action will be initiated against respondent No.3 after verifying the construction put up by respondent No.3.
4. He further submits that the past notices issued against respondent No.3 may not hold any water in the light of amendment carried out to the building bye-laws recently and that in view of the fact that respondent No.3

is at liberty to make necessary application for sanction of a modified plan.
5. Hence, the following:
ORDER i. The Writ Petition is hereby disposed of with a direction to respondent Nos.1 and 2 to inspect the property of respondent No.3 and if the same is found to be in violation of the building bye-laws and the sanctioned plan, to initiate appropriate action against respondent No.3 in accordance with law. ii. The said exercise shall be completed within a period of four (04) months from today. iii. It is needless to state that if respondent No.3 is of the opinion that any part of her construction can be saved as per the amended regulations and bye-laws, she is

at liberty to make such application to the respondent - BBMP / GBA and while passing orders, the respondent - BBMP / GBA will also take into consideration the amended bye-laws.
