The present application has been filed on behalf of the petitioner seeking stay of the vacation notice dated 24th June, 2026 passed by the respondent no.1/MCD. 2. By the impugned vacation notice, all the occupants of the property bearing House No. 22, Bazar Lane, Jangpura Bhogal, New Delhi-110014 (hereinafter ‘subject property’) have been asked to vacate the subject premises so that demolition action can be taken by MCD. It is stated that the present writ petition has been filed for the removal of unauthorised construction that has been raised by the private respondents no.3 and 4 on the 4th floor of the subject property. In terms of the order passed by the respondent no.1/MCD on 9th February 2024, it has been noted that the unauthorised construction pertains to the 4th floor of the subject property. 4. Counsel appears on behalf of the private respondents no.3 and 4 and submits that the said respondents have challenged the demolition order as well as the vacation notice issued to them before the Appellate Tribunal MCD (‘ATMCD’) and vide order dated 28th May, 2026, an interim protection has been granted in their favour. 5. Counsel for the petitioner submits that he may be granted two (2) weeks’ time to approach the ATMCD against the aforesaid demolition order and/or the vacation notice. 6. Having heard the counsel for the parties, it is deemed appropriate that two (2) weeks’ time be granted to the petitioner to approach the ATMCD. For a period of two (2) weeks, no coercive action shall be taken qua the portion of the property occupied by the petitioner. 7. In view of the aforenoted developments, the present writ petition stands disposed of while directing the respondent no.1/MCD to take appropriate action based on the outcome of the appeals filed before the ATMCD.
