Heard Sri Rapeti Suryanarayana, learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and Sri ASC Bose, learned Standing Counsel for Municipal Corporation appearing for respondent No.2. 2

The instant Writ Petition is filed challenging the proceedings dated 16.06.2026 of the 2nd respondent-Corporation issued under Sections 452(2) & 461(2) read with 428, 429 of the Andhra Pradesh Municipal Corporations (APMC) Act, 1955 and Section 89(3) of the Andhra Pradesh Metropolitan Region and Urban Development Authorities (APMR & UDA) Act, 2016 confirming the alleged deviation. 3. It is contended by the petitioner that the petitioner had purchased a house plot admeasuring 267 Sq. yards by way of a registered sale document bearing No.6300/2025 dated 09.10.2025 to build a residential house on the said piece of land. The petitioner has approached the authorities for sanction of building construction permission. Permission was accorded by the Municipal authorities for construction of Stilt + Ground + two upper floors. After completion of the construction, the 2nd respondent-Corporation affixed notices under Sections 452(1) & 461 (1) of APMC Act, 1955 & Section 89(1) & (2) of UDA Act, 2016 at the premises requiring the petitioner to remove the unauthorized construction within 7 days failing which they would appropriate action to pull down the same. The petitioner has requested the authorities to impose penalty and regularize the unauthorized constructions as according to the petitioner the deviations are minor, relating to setbacks within the premises. 4. It is further contended by the petitioner that the deviations are minor capable of regularization, without examining the request of the petitioner.
The Corporation mechanically issued the proceedings for removal of the

unauthorized structures. In the said regard, the learned counsel for the petitioner submits that the representation dated 24.06.2026 is pending before the 2nd respondent. 5. Having regard to the above, this Court is of the considered view that seeking regularization of the alleged deviations the petitioner has made a representation dated 24.06.2026 to the Corporation and the same is pending for consideration. 6. In the light of the foregoing, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondent No.2 to consider and pass appropriate orders on the representation dated 24.06.2026 of the petitioner, within a period of eight weeks from the date of receipt of the copy of this order. 7. Pending consideration of the said representation, the respondent- Corporation is directed not to take any coercive measures pursuant to the confirmation order dated 16.06.2026 issued by the 2nd respondent. 8. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
