By way of the present transfer petition under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, who is the complainant in CC NI Act No. 4291/2025 pending before the learned Judicial Magistrate First Class (“JMFC”)-05, South East District, Saket Courts, New Delhi, seeks transfer of the said proceedings to the Court of the competent Magistrate in the South West District, Dwarka Courts, New Delhi. 2. Ms. Gunjan Kathuria, learned counsel for the petitioner/complainant, submits that the complaint was inadvertently instituted before the Courts in the South East District on the premise that the cheques in question had been deposited within the said jurisdiction. She, however, submits that the complainant’s bank account is maintained within the territorial jurisdiction of the District Courts, South West This is a digitally signed order. Having considered the aforesaid and noting that summons have not yet been issued in the complaint proceedings, it is not necessary to issue notice to the respondent. 4. In view of the aforesaid facts and circumstances, the present petition is allowed. Accordingly, CC NI Act No. 4291/2025 is transferred from the Court of the learned JMFC-05, South East District, Saket Courts, New Delhi, to the Court of the jurisdictional Magistrate in the South West District, Dwarka Courts, New Delhi. 5. The petition, alongwith the pending application, is disposed of. 6. List before the learned Chief Metropolitan Magistrate, South West District, Dwarka Courts on 23.07.2026, for further directions.
