BEFORE HONOURABLE MRS. JUSTICE SHAMIMA JAHAN ORDER 28.07.2026 Heard Mr A B T Haque, learned counsel for the petitioners. Also heard Mr Bankim Sarma, learned Additional Public Prosecutor for the State of Assam. 2. By this application, the petitioners have prayed for pre-arrest bail in connection with Silchar PS Case No. 444/2026, registered under various Sections of law. 3. The FIR, on the basis of which the petitioners were arrayed as accused persons was lodged by one Mangala Bhar, stating inter alia, that while she along with her sister’s husband and sister’s children went to the house of a Brahmin family located in front of her house, the petitioners suddenly entered with weapons in their hands and started abusing her and alleged that she was involved in some bad deeds.
She also stated that when the petitioners attacked her she took shelter in the bathroom with sister’s children, but the petitioners broke open the door and had assaulted her severely and that her private parts were also molested. It is also alleged that a videography was recorded with regard to the said incident and was put in the social media. 4. The learned counsel for the petitioner, however, submits that the entire story projected in the said FIR is incorrect and that he had pleaded in Paragraph-6 of the bail petition that the actual fact is that the informant had an illicit relationship with the priest of the said Brahmin family and while they were engaged in illegal physical intimacy, the village people had gathered and that the petitioners had, in fact, reached the place of incident to save the priest. 5. Mr B Sarma, the learned Additional Public Prosecutor for the State, on the other hand, submits that ingredients of Section 117 of the BNS, 2023, is read large in the FIR and that the informant was badly assaulted by the petitioners concerned. 6. Upon consideration of the submissions made by the learned counsels and more so,
Page No.# 4/4 the fact stated by the informant in the FIR that the petitioners after beating her up had made a video and had posted it in the social media, the story narrated by the informant in the FIR seems to be camouflaged and as such, this Court deems it fit that the petitioners be released on pre-arrest bail on furnishing a bail bond of Rs. 20,000/- each, with one local surety each to the satisfaction of the arresting authority, under the following conditions:- i) the petitioners shall appear before the Investigating Officer within 10 (ten) days from the date of the order; and ii) the petitioners shall not hamper and tamper with the evidence of the case, and/or influence the witnesses. 7. Bail Application stands disposed of.
