11.02.2026 Ct. No. 30 SL No.30 MKP CO 1295 of 2023 Mina Dhar @ Mina Dhar (Dey) And Anr. Vs. Smt.Gitasree Nag And Ors. Mr. Saptarshi Kumar Kundu ………………for the Petitioner Ms. Deblina Lahiri Mr. Mrinmoy Chatterjee ……for the O.P. 1. In course of hearing, it is submitted by the Learned Counsel for the parties that during pendency of the revisional application the suit was dismissed for default and an application praying for it’s restoration is pending. 2. The petitioner has challenged an order of the Trial Court stating that the petitioner herein, had not been permitted to cross-examine one Smt. Gitasree Nag. 3. The Learned Counsel for the opposite party submits that the said submission as placed is not correct, as prima facie the petitioner had the opportunity to cross-examine the said witnesses and evidence had been closed. But, considering the suit has been dismissed in the interim period, the civil revision at this 2 stage is infructuous and accordingly disposed of without going into the merit of the case. 4. Civil Revision is disposed of. 5. Applications, if any, connected thereto stands disposed of consequently. 6. Interim order, if any, stands vacated. 7. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities. [Shampa Dutt (Paul). J]
