Page No.# 2/3 apprehending arrest in connection Palasbari P.S Case No. 95/2026 u/s 305/325 of BNS, 2023 r/w section 11(1)(d) Prevention of Cruelty to Animals Act, 1960 r/w section 13(1)/16 of the Assam Cattle Prevention Act, 2021 (corresponding to G.R Case No. 294(K)/2026). 3. The allegation in the FIR dated 22/04/2024 is that based on an information, the Palasbari Police intercepted two vehicles found to be carrying cut cattle tied in a cruel manner. The drivers could not produce any documents and suspecting the cattle to be stolen, the vehicle and cattle were brought to Palasbari Police Station and subsequently the drivers revealed that the cattle was being taken to the slaughterhouse of Mobarak Ali. The Police searched his house and found some cattle skin and two horns. 4. The learned counsel for the petitioner has drawn attention to a certificate issued by the FSSAI (the Food Standards Authority) giving license to the said Mobarak Ali for running a beef shop and the license is valid till 30/12/2028 as per certificate. He submitted that the petitioner has not violated any provisions of the cattle law in Assam and that besides being aged about 64 years, he also suffered from cardiac ailments. 5. I have perused the annexed medical documents. 6. Learned Additional P.P submits that charge-sheet in this case has already been submitted vide C.S. No. 132/2026 dated 25.07.2026. 7.
Having regard to the nature of the allegation and the fact that the petitioner pursuant to interim protection granted by this Court has appeared before the I.O, as submitted by the learned counsel, there appears to be no necessity of taking the petitioner into custody on the purpose of facing the trial. 8. Accordingly, the prayer for pre-arrest bail is allowed. 9. The order of interim pre-arrest bail dated 04.05.2026 is hereby made absolute on the same terms and conditions as may be applicable as of date. 10.
