Also heard Shri R. Talukdar, learned State Counsel and Shri B. Das, learned Standing Counsel, APDCL. On the last occasion, Shri Das, learned Standing Counsel has raised a preliminary objection on the maintainability of the writ petition due to availability of arbitration clause for resolution of the disputes. Accordingly, this Court, after recording a prima facie opinion had directed the learned counsel for the petitioner to obtain instructions. Shri Tamuli, learned counsel for the petitioner has fairly submitted that on the availability of arbitration clause, he would invoke the said clause for resolution of the disputes and would not press the present writ petition.
