Case No. 27 of 2025 for the offence registered under Sections 103(1) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Gumla, is pressed into motion. It is a case of double murder and as per the FIR, this petitioner was returning along with Sukhdeo Munda and Budhram Munda and under influence of liquor, there was some altercation amongst them in which the petitioner is alleged to have assaulted the other two persons with Lathi, resulting in their death. It is submitted by the learned counsel on behalf of petitioner that there is no eye witness to the incidence and at best offence under Section 304 of the IPC will be made out as it was not premeditated assault and the incidence took place on the spur of moment when heated exchange took place amongst them. Learned A.P.P. opposed the bail petition. It is submitted that the deceased persons were indiscriminately assaulted by stick resulting in their death. Other witnesses have also supported the prosecution case. Weapon of offence and the dead bodies were recovered on the disclosure statement made by the petitioner. Under the circumstance, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. (Gautam Kumar Choudhary, J.)
