Present appellant, who is not arrayed as party in said writ petition, has filed an application for being impleaded as a respondent therein. It is submitted that land in question is a water body and respondents – writ 2 HCJ & CGR, J WA_1113_2026 petitioners are encroachers thereupon. Reference has been made to earlier writ petitions – WP.Nos.23239 of 2005 and 32495 of 2018 filed by Razaka Jana Sangam and present appellant respectively. Reference has also been made to WP.No.10660 of 2024 filed by respondents - writ petitioners, in which interim stay initially granted has been subsequently vacated. It is submitted that complete facts have not been brought to notice of learned writ Court by writ petitioners; subject land is a public water body, therefore, there can be no question of regularization of writ petitioners’ possession. 3. We have heard learned counsel for parties. 4. It is a matter of record that WP.No.21208 of 2026 is pending adjudication before learned writ Court. Application filed by present appellant seeking impleadment in said writ petition is also pending. Learned counsel for respondents – writ petitioners submits that even though present appellant has no locus standi as such, there is no objection to his being impleaded as a party to writ petition. 5. Keeping in view the facts and circumstances, we do not find any ground to cause interference in this appeal, at this stage. Appellant is at liberty to raise all available pleas before learned writ Court. Learned writ Court is requested to look into the matter. Application for impleadment as well as application seeking vacation of stay, if any, be considered by learned writ Court. It is brought to our notice, at this stage, that writ petition has not been 3 HCJ & CGR, J WA_1113_2026 listed for an actual date after 15.09.2026. WP.No.21208 of 2026, along with applications, be listed before learned writ Court on 30.09.2026. 6. Writ Appeal is disposed of accordingly. There is no expression of opinion on merits of the matter which is within the realm of consideration by learned writ Court. No costs. Pending application(s) if any stand(s) disposed of accordingly.
