S. Deuri, the learned counsel appearing on behalf of the Petitioner. Mr. K. Gogoi, the learned Additional Senior Government Advocate appears on behalf of the State Respondents. 2. The instant writ petition is filed by the Petitioner challenging the non-payment of the admitted amount of Rs.3,66,086/- for hiring the vehicle of the Petitioner by the Respondent Authorities. 3. The case of the petitioner in brief is that the Petitioner is the registered owner of a vehicle bearing Registration No. AS-01- AU-9012 (Maruti Omni Van). On 01.01.2015, the vehicle of the Petitioner was requisitioned by the Respondent Authorities for the purpose of transportation and maintaining law and order situations within the city of Guwahati, Assam, and the said vehicle was released on 30.06.2015. Thereafter again on 01.01.2016, the said vehicle was requisitioned for similar purposes and was released on 30.06.2016. In the year 2016, after the release of the vehicle on 28.07.2016, the Petitioner had submitted his hire charge bill amounting to Rs. 1,82,539/- and Page No.# 3/6 again in the year 2017 on 28.01.2017, the Petitioner had submitted his hire charge bill amounting to Rs. 1,83,547/- before the Respondent No.2, i.e. the Commissioner of Police, Guwahati totalling Rs.3,66,086/-. However, the Respondent Authorities had not yet released the said outstanding bill amount of Rs.3,66,086/- to the Petitioner. 4. The learned counsel appearing on behalf of the Petitioner submitted that the Petitioner has been pursuing the matter diligently with the Respondents, but the Respondent Authorities have not shown any interest in making the payment of the admitted amount of Rs.3,66,086/- due to the Petitioner for which the Petitioner is facing hardship. The learned counsel for the Petitioner further submitted that the Respondent Authorities have failed to discharge their duty in accordance with law and the same has caused prejudice to the Petitioner. Hence, the Petitioner has approached this Court by filing the instant writ petition. 5. Mr. K. Gogoi, the learned Additional Senior Government Advocate has placed before this Court certain communications issued by the Office of the Commissioner of Police, Guwahati, Assam which are collectively kept on record and marked with the letter “X”. 6. From a perusal of the said communications, it is seen that Page No.# 4/6 the Respondent Authorities have admitted their liability of an amount of Rs.3,65,078/-. The details can be seen from the contents of the communication dated 22.01.2026 which being relevant is reproduced herein under:- “GOVT. OF ASSAM OFFICE OF THE COMMISSIONER OF POLICE GUWAHATI, ASSAM _______________________________________________________ Memo No. ECP/Hire Charge/High Court/2026/426 Dated: 22/01/2026 To, The Deputy Commissioner of Police (Crime), Police Commissionerate, Guwahati Sub: Status Report in respect of WP (C) No. 5985/2025 Pradip Kr. Das -Vs- The State of Assam & Ors. Sir, With reference to the subject cited above, I am directed to state that the petitioner Pradip Kr. Das has claimed an amount of Rs.3,66,086.00 (Rupees Three Lakh Sixty Six Thousand and Eighty Six) on hire charge vehicles between different periods w.e.f 2015 to 2016. In this connection, it is pertinent to mention here that, during scrutinization of each and every hire charge bill during the concerned period, it was found that the petitioner has claimed an excess amount of Rs. 1008.00 (One Thousand and Eight). That the actual claim amount should be Rs. 3,65,078.00 (Rupees Three Lakh Sixty Five Thousand and Seventy Eight). Henceforth, proposals amounting to Rs. 3,65,078.00 (Rupees Three Lakh Sixty Five Thousand and Seventy Eight) has been forwarded to Assam Police Headquarters, Ulubari, Guwahati for according necessary sanction. Das 01.01.2015 30.06.2015 Rs. 182539.00 AS-01-AU-9012 M/Van Pradip Kr. Das 01.01.2016 30.06.2016 Rs. 182539.00 Rs. 365078.00 Submitted for favour of your kind perusal and necessary action. Upon perusal of the materials on record, and more particularly, the above quoted contents of the communication dated 22.01.2026, it would be seen that the Respondents therefore admit that the Petitioner is entitled to the amount of Rs.3,65,078/-. Accordingly, the writ petition is disposed of with the following observations and directions:- i) The Petitioner is entitled to the amount of Rs.3,65,078/- as admitted by the Respondents. ii) The said amount of Rs.3,65,078/- be paid to the Petitioner after making such statutory deductions, if so required within a period of 6 (six) months from the date, a certified copy of the instant order is served upon the Respondent No.2, i.e. the Commissioner of Police, Guwahati. Page No.# 6/6 (iii) Any amount so paid during the pendency of the present writ petition towards the dues of the Petitioner shall be set off while making payment to the Petitioner.
